Residential & Commercial Services Agreement
This agreement is made by Junk In the Truck, LLC, D/B/A JunkGurus. The role of the JunkGurus is to help Client by working as a broker to facilitating subcontractors to take care of junk removal from a residence or commercial building owned or managed by the client. Our team of subcontractors will come to your residence or place of business, pick up the items that need to be disposed, place it in our dumpsters and/or haul it off to be properly disposed for an all inclusive and competitive price! We often remove appliances, mattresses, cardboard, furniture, construction debris and much more! In order to help ensure the parties are on the same page, the terms and conditions are as follows:
Scope of Work:
a. Clients are responsible for providing true and accurate estimates of the scope of work by description and/or pictures of the items to be disassembled or removed.
b. Disassembly shall be minor only, i.e., only such requiring less than 15 minutes to break down or remove, and shall not include disconnecting plumbing or hard-wired electrical connections. If non-minor disassembly is required, item(s) will be left behind.
c. The Client or their designated agent/representative are required to be at the job site unless it’s a curbside pickup only.
Safety & Disposal Information. In compliance with state and federal regulations and for the safety of our team and clients:
d. The maximum stackable load height when using truck bed or utility trailer is 6 feet tall, measured from the ground to the top of the load. The load height may NOT exceed this height under any circumstances.
e. Load Limits – Subcontractors are not permitted to overload their vehicle.
f. All items will be disposed of legally in any manner suitable to JunkGurus, which may include disposal, recycling, donation, refurbishment, consignment, resale, etc.
g. Subcontractors shall not perform any sort of demolition work.
h. Subcontractors specifically do not haul away the following types of items: Biohazardous waste, Hazardous waste, yard waste, concrete. Gurus also do not take items or enter homes with flea, lice, bed bug or other ectoparasite infestations. Biohazardous items include but are not limited to the following: bandages, gauze, personal protective equipment (gloves, gowns, goggles, plastic tubing), Needles, scalpels, syringes, lancets, any items exposed to potenially infectious material and is capable of puncturing human skin, limbs, specimens, tissue samples, empty vials, empty intravenous bags, tubing and bottles which were used in the administration of chemotherapeutic drugs, cultues and stocks that contain human disease-causing agents. Hazardous items include but are not limited to the following: chemicals, tires, motor oil, automobile batteries, paints and solvents, household cleaners, drain openers, pesticides, compressed gas tanks (such as propane and oxygen.)
Charges & Fees:
a. Client must provide valid credit card for deposit and payment.
b. $50 cancellation fee for all submitted and cancelled jobs.
c. If the job requires more than the quoted trips or vehicles for weight or size, Client will be notified, and upon acceptance is responsible for all costs. If Client is not present at the job site or is unable to be reached, the subcontractors will either haul away the extra at the current overage rates based on weight/size/etc., or leave excess material present and reschedule a subsequent pickup unless otherwise agreed to in advance.
d. Clients using invoicing ad their payment method are required to settle their payment NET30 terms.
e. Failure to receive invoice payments within net 30 terms may result in an imposition of interest at the monthly rate of three percent (3%) on the outstanding balance.
f. All JunkGurus invoices are automatically generated and sent to the email address or billing email address associated with your JunkGurus account immediately upon job completion.
g. Checks written & mailed within Net 30 may be considered on time due to postal uncertainties.
JunkGurus Commitment
1. The JunkGurus requires that all subcontractors are fully insured, and requires all subcontractors to perform background checks on all of their representatives who will be physically present on a Client’s job site.
2. JunkGurus will provide a straightforward, flat price quote based on the information provided by the Client.
3. As is customary, the Subcontractors may realize upon arrival that the items are heavier, bigger, or there is simply more of it than was provided and if price adjustments will be required, we will communicate those to the Client in writing.
4. We will always strive to be transparent and up front so the Client can make informed decisions about the price, timing and cost of services.
Limitations of Liability
JunkGurus shall not liable for damage to the premises or missing or damaged items, but shall assist with Clients who have potential claims to contact subcontractors to facilitate a proper resolution. Further, Client agrees that should JunkGurus have any liability, the maximum liability shall be a limited to the fee that JunkGurus was paid and no more unless otherwise excepted by applicable state and federal law.
Other Important Legal Terms & Conditions
1. Entire Agreement. This Agreement, along with the form Quote provided via email or the website contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof.
2. Non-Compete. Clients agree that they shall not seek to directly hire on a temporary or permanent basis any of the JunkGurus employees, subcontractors or agents for any job within 60 miles of a job site for a period of 12 months after the last date of service unless otherwise agreed to by JunkGurus.
3. Grievance/Mediation. Both parties agree that in the event a Client has a grievance regarding the services rendered, they must submit a formal, written demand followed by mediation is required to allow JunkGurus opportunity to remedy the situation prior to filing suit, and this paragraph may be pled in bar of any suit filed prior to mediation taking place.
4. Attorneys Fees. Client is responsible for all reasonable attorneys fees of JunkGurus in the event of a breach of this agreement, non-payment/collections, or the event of a lawsuit against JunkGurus in which JunkGurus prevails. Additionally, Client is responsible for all of their own attorneys fees unless otherwise required by applicable state and federal laws. Attorneys fees include billed expenses, clerks, paralegals, and attorneys and any other reasonable and customary fees incurred in the course of legal representation.
5. Governing Law & Forum Selection Clause. This Agreement shall be governed by the laws of North Carolina, and the parties agree that any and all disputes shall be resolved by a court of competent jurisdiction within Forsyth County, North Carolina.
6. Severability. In the event that any part of this document is severed by a Court or rendered moot by statute, the rest of the Agreement remains in full force and effect.
